Mohali: Automobile company told to repair defective scooter, refund ₹86k if it fails
Mohali Consumer Panel Sets Deadline for Repair of Electric Scooter
Bharatmorningnews.com – Mohali - A Mohali consumer commission has ordered Ola Electric Technologies Pvt Ltd and its Phase-2 service centre to repair a customer’s electric scooter within 30 days, finding that the vehicle owner faced a prolonged and unresolved service issue. If the scooter is not restored to roadworthy condition within that period, the company must refund the purchase price of ₹85,999 with interest.
The district consumer disputes redressal commission also awarded ₹25,000 to the buyer, Munna Ali of Barmajra, for mental agony, harassment and litigation expenses.
Scooter Purchased Through Ola Application
Ali bought the electric two-wheeler through the Ola Electric application on July 28, 2024, paying ₹85,999 for the scooter. He separately paid ₹6,818 towards insurance.
The dispute began after the scooter developed a loud and unusual sound from its hub motor on October 1, 2025. Ali took the vehicle to Ola’s Phase-2 service centre that day. However, the service request was generated on October 6, several days after the scooter had been submitted.
He maintained that repeated emails, calls and visits did not result in a repair or the return of his vehicle. The scooter remained at the service centre for more than two months, even though complaint tickets had been raised.
Vehicle Condition Raised Before Commission
Ali told the commission that the scooter was in good condition when he left it at the service centre. He later alleged that it had been kept exposed to dust and weather, resulting in deterioration to the paintwork and body. Photographs and videos placed before the panel supported that claim.
Consumer disputes involving vehicles can extend beyond the original mechanical problem when customers are left without a clear repair timeline or when a vehicle deteriorates while in the workshop’s custody. The commission’s direction places emphasis on making the scooter usable again while also setting a financial consequence if that outcome is not achieved.
The order was issued by commission president SK Aggrawal and member Paramjeet Kaur.
Defence Filing Right Struck Off
The commission recorded that Ola did not submit its written response within the required 45-day period. Its right to place a defence on record was consequently struck off in June 2026.
After holding the company and service centre deficient in service, the panel nevertheless gave them an opportunity to fix the scooter. The work must be completed within 30 days from receipt of a certified copy of the order.
The repair process must also be photographed and videographed. This requirement creates a record of the work performed and of the scooter’s condition during the process, which may help prevent further disagreement over whether the vehicle has been properly restored.
Refund Required if Scooter Cannot Be Made Roadworthy
If the scooter cannot be repaired and made roadworthy within the deadline, Ola must return ₹85,999 to Ali. The refund will carry interest at 6% per year from December 8, 2025, when the consumer complaint was filed, until the amount is paid.
The insurance amount of ₹6,818 was noted as part of the purchase-related payments in the case, while the specific refund direction concerns the scooter’s ₹85,999 purchase price. In addition to that sum and interest, the opposite parties have been directed to pay the ₹25,000 compensation and litigation-cost award.
For electric vehicle owners, the case underlines the value of keeping service receipts, complaint numbers, emails, photographs and videos whenever a vehicle is deposited for repair. Such records can establish when a fault emerged, when the vehicle entered the workshop and whether the issue remained unresolved for an unreasonable period.
The order also highlights that a repair obligation is not fulfilled merely by opening a complaint ticket. A customer ultimately needs a properly functioning vehicle or an effective remedy when repairs do not take place within a reasonable and legally directed timeframe.
