Trump Labor Department Faces Lawsuit for Withholding Workplace Diversity Data

Trump Labor Department sued over withholding – A coalition of shareholders, represented by As You Sow, initiated legal action against the Trump administration, alleging the government has delayed releasing workforce diversity statistics for over two years. The case, filed in a Washington, D.C. federal court, focuses on the Department of Labor’s handling of a public records request under the Freedom of Information Act (FOIA), as reported by USA TODAY.

According to the lawsuit, As You Sow submitted a request for diversity data spanning 2021 and 2022 but has yet to receive the information. This data, which includes breakdowns by race and gender, is critical for analyzing the relationship between corporate diversity and financial outcomes. The group previously utilized such metrics to publish studies on the topic.

“Workforce diversity is a key factor in business strategy that many investors weigh heavily,” said Andrew Behar, CEO of As You Sow. “Without access to this data, they’re operating without visibility.”

Investors are also concerned about the potential impact on transparency. Danielle Fugere, president and chief counsel of As You Sow, emphasized that the absence of data leaves decision-makers “flying blind,” as noted by USA TODAY.

Companies are mandated to submit employee demographic reports called EEO-1 forms annually. These have been a tool since the 1960s for tracking workplace discrimination and aiding civil rights enforcement. The Trump administration, however, has pushed to eliminate these reports as part of its DEI policy shifts.

Tom DiNapoli, New York State Comptroller, plans to challenge the EEOC’s decision to stop collecting EEO-1 data. He argued that the metrics help investors assess talent management, operational risks, and long-term performance. “Transparency strengthens financial markets, not weakens them,” he stated in a USA TODAY interview.

States Continue Diversity Reporting Requirements

Despite federal efforts to scale back EEO-1 data collection, several states like California and Illinois maintain their own mandates for workforce demographic reports. Colorado recently enacted legislation requiring employers to submit EEO-1 data to the state starting in July 2027, signaling growing state-level interest in the issue.

The lawsuit underscores ongoing debates about the role of race-based statistics in corporate accountability. While the Trump administration and its allies advocate for reduced data collection, advocates like As You Sow stress its importance for equitable policy and informed investment.
